Fayernote Privacy Policy
This Policy applies to the Fayernote applications, website and related services provided by Fayerhill Technology (Chengdu) Co., Ltd. (“Fayernote,” “we,” “us” or “our”). It explains what personal information we process, why we process it, when it may be shared, how long it is kept, and the choices and rights available to you.
1. Information we process and why
We process personal information lawfully, fairly, transparently and only to the extent reasonably necessary for a stated purpose. If we introduce a materially different purpose or category of information, we will provide additional notice and obtain consent where required.
| Category | Examples | Main purposes |
|---|---|---|
| Account and authentication | Phone number or email, verification records, Apple sign-in information, date of birth, display name and account identifiers | Create and secure your account, verify eligibility, sign you in and prevent misuse |
| Profile | Nickname, avatar and profile preferences | Display and manage your profile |
| User content | Text, recordings, transcripts, images, titles, summaries, topics, favorites and related timestamps | Capture, transcribe, organize, search, synchronize, restore and display your content; eligible anonymized text for model improvement only under Section 2 |
| Subscription information | Product, transaction, subscription status and relevant dates supplied by the purchase channel used, such as the App Store | Activate, restore and manage subscription benefits; we do not receive your full payment-card credentials |
| Device, usage and diagnostics | Device and app characteristics, generated identifiers, IP address, security events, feature interactions, processing status, errors and performance information | Maintain sessions, synchronize content, protect accounts, diagnose faults, measure essential product performance and improve reliability |
| Support, feedback and rights complaints | Contact details, communications, issue descriptions, relevant content identifiers and necessary supporting evidence | Respond to requests, investigate problems, verify authorization and handle complaints or disputes |
| Commercial information and recommendation preferences | Account and subscription status, feature usage and ad interactions, interests and preferences analysed or inferred from them, and advertising choice records | Recommend relevant commercial information and ads for us or third parties, measure promotional effectiveness, and manage your choices |
Analytics for measuring and improving the service do not include the body of your notes, full recordings, full transcripts, images, verification codes, access credentials or precise location. See Section 11 for commercial information and personalized recommendations.
2. Automated processing and user content
When you request transcription, summarization, classification, linking, search or other intelligent organization features, Fayernote may use automated processing, including machine-learning services, to process the text, audio, images and related context needed to provide that feature. Generated results may be stored with your content so they can be displayed and synchronized.
For delivering requested features, we limit processing to the data reasonably necessary for those features. Service providers that process information for us are subject to contractual, confidentiality and security requirements and may not use it for independent advertising or unrelated purposes. Model improvement is addressed separately below.
These features assist with organizing your content; they are not used to make decisions that produce legal or similarly significant effects about you. Automated results may be incomplete or inaccurate, and you remain able to review, edit or delete them.
You must have the rights needed to record, upload and use submitted content and authorize the processing you request from us. For other people’s personal information, meeting recordings, or employer or client information, give required notices and obtain necessary consents or permissions before the relevant action. Their scope must cover the cloud storage, transcription and AI processing you request. Comply with confidentiality obligations and do not submit sensitive information you have no right to process or that is unrelated to the feature used. Section 4 of the Fayernote Terms of Service sets out the recording requirements. You bear responsibility under applicable law for breaching these obligations. Our statutory personal-information protection obligations remain unaffected.
For sensitive personal information that you choose to submit, such as health or financial-account information, you authorize us to process it only to the extent strictly necessary to provide the storage, synchronization, transcription and organization you request. We apply strict safeguards and obtain separate or explicit consent before processing where required by law. Disclosure or misuse of such information may affect privacy, personal safety or financial security. You may withdraw consent as described in Section 8.
Model improvement and your choice
We may anonymize text from notes and transcripts and use the resulting samples to train, evaluate and improve our models, including large language models. This use is subject to applicable law; where separate consent is required, we will obtain it before proceeding. We will exclude samples that lack necessary permissions, are subject to confidentiality or upstream-use restrictions, have rights that cannot reasonably be verified, or fail anonymization checks. This arrangement does not authorize service providers to train their own models on your identifiable content.
You may opt out at any time by emailing
support@fayerhill.com with “Training opt-out” and the
necessary account identifier. We will verify and apply your request,
stop future selection, and exclude pending training samples still
traceable to your account; while verification is pending, the relevant
samples are held out of training. Opting out does not affect the core
service or purchased benefits.
Samples lawfully anonymized before your opt-out that can no longer be linked to your account may not be locatable for deletion by account and may continue to be used.
3. Permissions and information from your device
Fayernote requests a device permission only when you use a feature that needs it:
| Permission | Purpose | If not granted |
|---|---|---|
| Microphone | Record spoken ideas or meetings | Recording is unavailable |
| Camera or Photos | Capture or select an image for a note | That image-input method is unavailable |
| Location while using the app | Add a readable place label when you choose a location-aware feature | Automatic place labels are unavailable |
| Notifications and background delivery | Task reminders, processing-completion notifications and result synchronization | Reminders or notifications may be unavailable, and some results may require reopening the app |
You can manage these permissions in your device or system settings. Turning off a permission does not affect unrelated features or invalidate earlier lawful processing.
4. Cookies and similar storage
The app does not rely on browser advertising cookies. The public website uses only storage that is necessary to remember choices such as language and restore page state. We do not use it for advertising or cross-site tracking. If analytics or other non-essential technologies are introduced, we will update this Policy and provide controls required by law.
5. Service providers, sharing and disclosure
We may provide the minimum necessary information to categories of service providers that support:
- account authentication and requested communications;
- cloud hosting, storage, backup and content delivery;
- transcription and automated content organization;
- App Store purchases, subscriptions and notifications;
- security, reliability, customer support and legal compliance.
For providers processing information on our behalf, we agree on processing purposes, scope, confidentiality and security requirements, restrict use for their own purposes and exercise oversight as required by law. Where a provider independently determines processing purposes and means, we disclose the recipient, purposes and information involved and complete required notice and consent procedures. See the Third-Party Sharing List, which we update when material provider arrangements change.
We may display ads for third parties and provide advertising partners with aggregated performance statistics that do not identify you. If we introduce an advertising service provider that receives personal information, we will update the Third-Party Sharing List before that processing begins, identify the recipient, information categories and purposes, and complete notice and consent procedures required by law.
We may also disclose information when you direct us to share or export it; to protect users, the service or the public; to comply with law or a valid request from an authority; or with your separate consent. If a merger, acquisition, reorganization or asset transfer changes the entity responsible for your information, the successor must continue to protect it under this Policy and applicable law.
6. Storage, international transfers and retention
We operate from mainland China. Your personal information may be
stored and processed in mainland China, including information you submit
when using the service from another country or region. Where processing
involves other countries or regions, we will disclose the relevant
locations, recipients and purposes, and implement the safeguards,
notices and consent procedures required by applicable cross-border data
laws. You may contact support@fayerhill.com for information
about applicable transfer arrangements and a description or copy of the
safeguards available under applicable law.
We keep personal information only for as long as needed for the purposes described here, including the life of your account, and for any additional period required for security, dispute resolution, backup recovery or legal obligations. When information is no longer needed, we delete or anonymize it. Deletion from active systems and protected backups may occur on different schedules; during any necessary residual period, access and further use are restricted.
7. Security
We use reasonable organizational and technical safeguards appropriate to the nature of the information and the risk, including access controls, encryption in transit and where appropriate at rest, data minimization, separation of duties, monitoring, backup protection, provider review and incident-response procedures. No system is completely secure. If a personal-information incident occurs, we will contain and remediate it and notify affected people and authorities when required by law.
8. Your choices and rights
Subject to applicable law, you may request access to, a copy of, correction of, or deletion of your personal information; withdraw consent; object to or restrict certain processing; request data portability; and ask us to explain our processing rules. You may also complain to the competent data-protection authority.
You can edit or delete much of your profile and content in the app. To delete your account, use Profile → More Settings → Delete Account and complete identity verification. Account deletion does not automatically cancel an App Store subscription. For an App Store subscription, go to Apple Account → Subscriptions → Fayernote → Cancel Subscription; see Apple’s cancellation guide for where to find subscription settings on your device. You can withdraw device permissions in your device or system settings.
For a request you cannot complete in the app, email
support@fayerhill.com. We may verify your identity and may
limit a request where necessary to protect another person’s rights,
security, legal obligations or legally protected confidential
information. We will respond within the period required by applicable
law.
If content submitted by another user contains your personal information, you may also send a rights request or complaint to the email above, providing the information needed to locate the content and verify your rights. We will assess it and take appropriate action under applicable law. Any communication with the submitting user will disclose only information necessary to handle the request.
9. Regional privacy rights
Where the GDPR or UK GDPR applies, our legal bases may include performance of a contract, consent, compliance with law and our legitimate interests in securing and improving the service where those interests are not overridden by your rights. You may also object to processing, request restriction or portability, and lodge a complaint with your local supervisory authority.
Where California privacy law applies, you may have rights to know, access, correct or delete personal information, to opt out of sale or sharing, to limit certain uses of sensitive personal information, and to receive equal service when exercising your rights. Fayernote does not sell personal information or share it for cross-context behavioral advertising.
Applicable mandatory local rules take precedence over the general provisions of this Policy, including rules on sensitive information, anonymization, international transfers and disclosures in the local language. We provide additional disclosures and obtain any required consent before starting processing that requires them.
For Japan, where the APPI applies, we specify and disclose the purposes of use, apply the rules for special-care-required personal information and foreign recipients, and handle requests concerning retained personal data as required. If we create or provide anonymously processed information under the statutory regime, we comply with its processing, publication, security and non-reidentification requirements; ordinary masking is not treated as statutory anonymization.
For South Korea, where the PIPA applies, we disclose the processing entrusted and the actual entrusted entities, including applicable sub-processors, and provide the required information about international transfers and any applicable refusal choices before relying on a transfer arrangement. We provide Korean-language notices and obtain consent as required by law. The contact in Section 13 accepts privacy requests for these regions.
10. Minors
The service is intended for users aged 18 or older. We do not knowingly provide accounts to children. A parent or guardian who believes a child has provided personal information without appropriate authorization may contact us so we can verify and address the request.
11. Commercial information and personalized recommendations
To make commercial information more relevant to you, we may use
personal information such as your account and subscription status,
feature usage and ad interactions to understand your interests, show or
send you information about products, services, events and offers that
may interest you, including ads for us or third parties, and evaluate
promotional effectiveness. We do not use or infer sensitive personal
information, such as health information or religious beliefs, for
advertising recommendations. We provide the necessary notice and obtain
prior consent where required by law. You may use the available turn-off
or unsubscribe options, or contact support@fayerhill.com,
to opt out of personalized ads and the related processing or unsubscribe
from marketing messages. This does not affect the core service or
purchased benefits. Turning off personalized ads does not prevent you
from seeing ads that are not based on your personal characteristics.
We do not sell personal information or provide advertisers with your personal information or content, such as notes or recordings, for their own marketing. We do not track your activity across unrelated apps or websites.
12. Changes to this Policy
We may update this Policy to reflect changes in features, processing, service providers, law or security practices. If a change materially affects how we process personal information, we will provide a prominent notice and obtain renewed consent where required.
